Bradley Rein, 53, is facing a charge of reckless homicide by motor vehicle, according to Plymouth County District Attorney Tim Cruz.
The cause of the crash on Monday is still under investigation.
According to court documents from the hearing, Rein told police he was looking for an eyeglass store at a shopping centre when his right foot became stuck on the accelerator. He said he used his left foot to try to brake but couldn’t stop the vehicle from crashing through the front of the store, the documents say.
“Though the outcome of this accident was horrific … It was just that. It was an accident,” said Rein’s court-appointed lawyer on Tuesday.
Kevin Bradley, 65, was identified as the victim killed when the black SUV plowed into the store.
Rein’s next court appearance is set for 22 December.
‘Unthinkable morning’
District Attorney Tim Cruz called it an “unthinkable morning” when he confirmed one person was killed in the incident.
Sixteen people were taken to hospital and another patient walked into South Shore Hospital where 14 of the other patients were taken.
Dr Christopher Burns, the hospital’s trauma director, told NBC News they had multiple patients with life-threatening or limb-threatening injuries and several are currently in surgery.
Fire officials said bystanders and off-duty hospital workers were among those who jumped in to help give emergency treatment in the immediate aftermath of the crash.
One woman improvised a tourniquet from a spare jacket.

Driver named as 53-year-old Bradley Rein
The driver who plowed into a Hingham Apple store on Monday has been named.
Bradley Rein, 53, has been arrested and charged with reckless homicide by motor vehicle, according to Plymouth County District Attorney Tim Cruz.
Mr Rein, who is from Natick, is set to be arraigned on Tuesday in Hingham District Court.
Mr Cruz said the arrest was the result of an “extensive investigation” by Hingham Police and Massachusetts State Police.

Driver claims right foot got stuck on accelerator, court documents say
Before crashing into an Apple store in the Boston suburb of Hingham on Monday, Bradley Rein told investigators he’d been looking for an eyeglass store.
The 53-year-old, who has been arrested and charged with reckless homicide by motor vehicle, told authorities that while looking for the store, his right foot became stuck under the accelerator of his Toyota 4Runner, according to court documents.
He told them that he then tried to use the brake with his left foot, but failed to stop before crashing into the store, fatally wounding one person and injuring at least 19 others.

Driver Bradley Rein is waiting to be arraigned at Hingham District Court on Tuesday as he was charged with reckless homicide by motor vehicle after the deadly crash on Monday killed Kevin Bradley, 65, of New Jersey and left more than a dozen injured.
Boston 25 News was outside the court Hingham courtroom as Rein appeared ahead of his arraignment on Tuesday.
Prosecutors ask that driver’s bail be set at $100,000 cash
Prosecutors asked the judge presiding over driver Bradley Rein’s arraignment on Tuesday morning that his bail be set at $100,000 cash bail and requested that he not be permitted to operate a vehicle.
He denied consuming any blood or alcohol that day and blew 0.0 on a blood alcohol test on Monday.
He has no criminal records in Massachusetts, but there was a drunk driving misdemeanour that was expunged from his record in Vermont.
Defense for Rein argues deadly crash was an ‘unfortunate accident'
A defense attorney for driver Bradley Rein argued during his bond hearing on Tuesday morning at Hingham District Court that when the 53-year-old crashed into the Apple store in the Boston suburb on Monday morning it was an “unfortunate accident”.
The attorney laid out how Rein had cooperated with police immediately, volunteering to take both a breathalyser and blood test to verify his sober state of mind and proceeded to answer questions from officials during a recorded interview.
The attorney was asking the judge presiding over the case to set the cash bail for Rein at $20,000 and asked that it be set no higher than $50,000.
The prosecutor, however, asked that the 53-year-old’s bail be set at $100,00 cash and requested that Rein not be permitted to operate a vehicle throughout the case.
The defense laid out how Rein had no criminal history in the state of Masschussets, had plans to spend the upcoming holidays with his family and had no history of mental health issues while arguing for the less bail fee.
Homicide by motor vehicle is a misdemeanor charge in Massachusetts
Unless authorities are able to prove that the driver suspected of plowing his car into an Apple store in a Boston suburb on Monday was under the influence, the charage of homicide by motor vehicle will be considered a misdemeanor charge, NBC 10 reported.
Bradley Rein, 53, who was preparing to be arraigned on Tuesday for a charge of reckless homicide by motor vehicle, according to Plymouth County District Attorney Tim Cruz, was also issued a drunk driving citation back in December 2020.
In Masschusetts, homicide by motor vehicle is a misdemeanor charge, unless authorities can prove a person was under the influence of drugs or alcohol.
