The injunction prevents the BHB from forcing At The Races to pay significant fees and enter into data agreements, and also prevents the switching-off of the data feed.

ATR's pre-race data licence terminated last year when the company's original platform ceased broadcasting and the media rights agreement with 49 racecourses ended. When the channel relaunched in June 2004 it entered into an agreement with the Press Association for the supply of pre-race data and started negotiations with the BHB to obtain a licence to access the database. However, no agreement was reached.

Then BHB threatened to instruct the PA to cut the feed to At The Races if the racing authority did not receive licence-fee income.
