Baby death appeal
A test appeal is to be lodged by the Attorney-General, Sir Nicholas Lyell, to clarify whether a person who fatally wounds an unborn baby can be charged with murder or manslaughter. It follows the acquittal in 1993 of a man who killed his daughter by stabbing his pregnant girlfriend in the stomach. The jury was ordered to clear him of murder because no malice was intended towards the foetus.
