European Court of Justice rulings have thrown into confusion the contracting-out of services by local and health authorities and have raised questions over the practicality of the Government's pounds 1.5bn market testing of civil service functions. Some employment law experts believe that successful tenderers are required to re-employ existing staff on the same conditions of employment that previously applied.
