Kevin Spacey will not be charged with sexual assault after the man who accused him died unexpectedly.

The decision was announced by the LA County District Attorney’s office this week. The accuser was an anonymous masseur who claimed Spacey forced him to touch his genitals during a session at the Oscar-winner’s home in Malibu, California, in October 2016.

A spokesperson for the DA said: “The sexual assault allegations cannot be proven without participation of the victim. Thus, the case was declined.”

The man had also sued Spacey under the alias John Doe in a case that remains pending in federal court.

In July, a criminal case investigating allegations that Spacey groped an 18-year-old man at a bar in Nantucket in 2016 was dropped.

The previous year, LA prosecutors also declined to file charges against Spacey over an alleged incident in 1992, because it was beyond the statute of limitations.

Police in London are currently investigating allegations of sexual misconduct against Spacey, but there has been no recent update on the inquiry.

The Independent has contacted Spacey’s lawyer for comment.
